Bloggings: Will this newspaper story appear on January 22, 2013 ...

In answer to the March 29 ID item by?my colleague and fellow blogger, Matt Kolken, who is not only a top level lawyer but a dedicated and passionate advocate for justice in the immigration system, and who has my highest respect, I would like to draw attention to the following newspaper story, which I happened to run across after reading Matt's powerful and eloquent argument against voting to re-elect President Obama:

"Washington, January 22, 2013

President Mitt Romney made his first public appearance on the day after his inauguration as the nation's 45th president, flanked by Vice-President Marco Rubio and by Kris Kobach, Lamar Smith and Joe Arpaio, the president's choices for Attorney General, Secretary of Homeland Security and Director of the Bureau of Immigration and Customs Enforcement "ICE". Stating that the presence of 12 million illegal aliens in this country was the most urgent problem facing the US, dwarfing all the others combined, the new president announced that his top priority would be reforming America's broken immigration system, something his predecessor had talked a great deal about doing but never taken any action to bring about.?

President Romney began his statement by saying that respect for the law has completely broken down in America, and can only be restored by the immediate removal of every single illegal alien, without exception. He also stated that our legal immigration system must be overhauled to reflect America's priorities, values, culture, and identity, especially use of the English language, which is now under imminent threat, due to our misguided and overly permissive immigration policies dating back to 1965.?

For this purpose, President Romney announced, he was directing his presumptive new Attorney General, Mr. Kobach, to draw up immigration reform legislation for introduction in the new Congress, which is now overwhelmingly Republican in both houses as the result of last November's election. This legislation, to be modelled on a bill which passed the House of Representatives in 2005 but never reached the Senate, known as HR 3447, and on the immigration law now in full effect in Alabama (which the US Supreme Court has just upheld in a 5-4 decision based on 10th Amendment grounds), will make "attrition" the official immigration policy of the United States of America, and encourage all illegal aliens to "self-deport", thereby hopefully saving the government hundreds of billions of dollars on enforcement money. However all illegals who do not self-deport within a reasonable time, such as 60 to 90 days, will be removed by state as well as federal officials. States will be given the power to institute their own deportation hearings and to carry out removals in order better to assist the federal authorities.

Among other top priority immigration related legislative proposals which President Romney outlined was one which would take away birthright US citizenship from anyone who is unable to prove that his or her parents were both either lawful permanent residents of the US or US citizens at the time of his or her birth. This, law, the president emphasized, will be retroactive and will apply to all current US citizens, regardless of date of birth. The president added that he is instructing Mr. Kobach to assist in preparing a lawsuit asking the Supreme Court to overturn its landmark 1898 decision in Wong Kim Ark vs. US, which, the president said, takes an absurdly expansionist view of the 14th Amendment's guarantee of birthright citizenship.

'Liberal judicial activism' the president said, 'is bad for America in our century and it was bad for America in any century. This administration will act severely in order to stamp it out'. The president also announced a moratorium on all legal immigration, on national security grounds, until the 12 million illegals all return back home.The only exceptions, on a case by case basis, will be a limited number of science and math professionals who are fluent in English.

After the president's speech, the new ICE director, Joe Arpaio, made a few remarks about his plans to reform the immigration detention system. 'There's been a lot of screaming and yelling about conditions in this country's immigration jails',?Mr. Arpaio announced. 'We are going to put an end to that. These prisons are not hotels. In Arizona, we have shown that we know how to handle illegals.'

Vice-President Rubio concluded with some brief remarks thanking America's Hispanic and other minority and pro-immigrant voters for staying home or voting for third parties in record numbers in 2012, thereby enabling Mr. Romney to win the White House."

JetBlue co-pilot, unlikely hero, instant celebrity

(AP) ? Friends and relatives of the co-pilot of JetBlue Airways Flight 191 say he doesn't want to be considered a hero ? but that's exactly what many are calling him.

Pilots train for a whole range of in-flight mishaps including sick passengers, emergency landings and terrorist attacks. But Jason Dowd faced the rarest of scenarios: deciding whether to lock his incapacitated captain out of the cockpit and call for an emergency landing after Clayton Osbon became unruly and had to be subdued by passengers.

Dowd is staying out of the public eye for now, but a wave of overnight fame ? much like 'Miracle on the Hudson' Capt. Chesley Sullenberger ? likely awaits. JetBlue says the decision on whether to go public is up to him, but the airline is not commenting more out of respect for his privacy. Public relations experts say there are big pros and cons to going public, like what "Sully" and his co-captain Jeff Skiles experienced in the aftermath of their emergency landing in the Hudson River.

"For some folks it's a lot to deal with ? especially all at once," said Dr. Ron Bishop, a professor of culture and communication at Drexel University in Philadelphia. "It seems given all the outlets and different means in which we communicate, the attention paid to a person in that situation is ramped up considerably."

According to court documents, Osbon became increasingly incoherent on board the Las Vegas-bound flight Tuesday, and Dowd was "really worried" when Osbon told him "we need to take a leap of faith." Concerned about Osbon's behavior, Dowd suggested they invite an off-duty JetBlue captain who was flying as a passenger to come into the cockpit, but instead, Osbon left the cockpit and later sprinted down the cabin yelling jumbled remarks about Sept. 11 and Iran, documents and witnesses say.

The off-duty captain then joined Dowd, and from inside the locked cockpit, which Osbon tried to re-enter by banging on the door, the co-pilot gave an order through the intercom to restrain Osbon, according to the documents, which don't mention Dowd by name. Passengers wrestled Osbon to the ground, and Dowd diverted the flight from New York to Amarillo, Texas. No one onboard was seriously injured.

Federal prosecutors have charged Osbon, 49, with interfering with a flight crew and he is under medical evaluation at an Amarillo hospital.

Dowd doesn't consider himself a hero, relatives said Thursday. But his actions on board Tuesday's flight were not a surprise to friends and family.

"I'm glad for those people he was the co-pilot that day," said Dowd's mother-in-law, Ruth Ann Kostal. Dowd, who lives in his hometown of Salem, Ohio, with his wife and their two young children, hasn't been able to come home yet because he's still being interviewed by federal authorities in New York, Kostal said. He has made no public comments about Tuesday's flight.

"I can see him being a hero. It does not surprise me one bit that he acted so professionally," said Patty Eaton, a secretary at the church Dowd's family attends.

Passengers, including those who helped restrain Osbon, also credit Dowd for landing their plane safely. David Gonzalez, a 50-year-old former New York corrections office from Tannersville, Pa., who helped tackle Osbon, said the co-pilot is the "real hero" for getting the captain out of the cockpit and locking the door so he couldn't get back in.

"It's because of his actions that we're here," Gonzalez said of Dowd.

David E. Johnson, CEO of Strategic Vision, LLC, a leading public relations agency, said if Dowd comes forward, it would likely give JetBlue a needed public relations boost.

"JetBlue needs someone to really step to the forefront. It's the second person there that's gone berserk they need to show that they've got good and heroic employees," he said.

In 2010, JetBlue flight attendant Steven Slater pulled the emergency chute on a flight after it landed at John F. Kennedy International Airport. He went on the public-address system, swore at a passenger, grabbed a beer and slid down onto the tarmac. He was sentenced to probation, counseling and substance abuse treatment for attempted criminal mischief.

As much as JetBlue likely wants to put Slater's and Osbon's outbursts behind them, Johnson said there's another reason why Dowd may not want to go public.

"He's probably just very low key and just thinks he did what he was supposed to do," Johnson said.

Sullenberger talked extensively about his unlikely celebrity status after crash landing in the Hudson in 2009. He later wrote a book, took part in the making of a documentary and spoke out on issues affecting pilots, including pensions and flight hour regulations. But the shine of the public eye was overwhelming at times, and he equated it to having a fire hose pointed at him.

A spokeswoman for Sullenberger said he declined to comment on this story. His co-pilot Jeff Giles couldn't be reached for comment. Both gave up their flying careers after the accident.

For Dowd, fame could bring opportunities, but Johnson said the pros have to be weighed with the burden of constant attention.

"It will bring some attention to him when he'd rather have it just fade away," Johnson said. "But Sully was your American hero. Sully was apple pie. And this guy might be as well."

99% A Separation

Dynamically shot and paced like a thriller, the film has the density and moral prickliness of a good novel.

These people seem so real they might live next door. And they probably do.

Very few movies capture as convincingly as A Separation does the ways in which seemingly honorable decisions can lead to interpersonal conflict -- even disaster.

To say the piercing Iranian film A Separation is about divorce is a bit like saying The Wizard of Oz is about a pair of slippers.

"A Separation" moves beyond one couple's sundering marriage to reveal growing rifts between generations, ideologies, religious mind-sets, genders and classes in contemporary Iran.

"A Separation" is a great movie, a look inside a world so foreign that it might as well be another planet, yet so universal that its observations are painfully familiar to anyone, anywhere.

... subtlety and a sense of profound decency ...

A clever, insightful and heartfelt examination of human frailty that makes watching subtitles seem like a breeze.

It's fast paced, exciting, thrilling, edgy, moving, engaging, and - in its portrait of a justice system almost radically alien to the one I live under - absolutely fascinating.

Although the film might serve as a portrait of Iran's two conflicting social groups as reflected in the Green movement/Ahmadinejad clashes, it is much more about moral contradictions that any society has to face. A masterpiece.

It's the little moments in Farhadi's film that are its most important, speaking every bit as loudly as its big, narrative-driving moments.

If any one film can re-inject life into an entire national cinema, it's A Separation.

You may also find that some aspects of this very foreign story seem disturbingly not all that foreign.

An outsider could see these characters as misguided. That's not the reality however. Farhadi slips us into their shoes and we appreciate each of their perspectives.

Asghar Farhadi has written a superb screenplay and directs it with equal brilliance. He has managed to make a film that says something about the state of affairs in his Iran and weaves that message into an engrossing tapestry of mystery and drama.

The complex realities of human emotions and experience are more than sufficient to carry a film, and Farhadi doesn't let fussy direction or attempts to be overly clever get in the way of letting this brilliant, quietly insightful story unfold.

A clarion cry that cuts through the xenophobic clutter and the dense fog of war to show that not everyone "over there" is a boogeyman waiting to jump out of the closet. If that sounds terribly simplistic, just consider where we live.

A Separation is more than a character study; it's a deftly plotted drama that unfolds layer after layer and will leave you asking all kinds of questions about your beliefs and moral judgments. Fascinating stuff.

The story has no winners, and the daringly ambiguous ending defies simple conclusions. Even the title can be taken multiple ways.

The movie opens the door on a foreign culture, yet the people do not seem that dissimilar. .... They deal with some of the same struggles ... -- generational and class conflicts, ideological differences, and connecting and communicating emotionally.

A devastating portrait of two families in crisis, with their class differences representing the title's true 'separation.'

"A Separation" deals with some very murky issues, but it does so with astonishing clarity.

The movie is a singular mix of the foreign and the familiar, but is it the best 2011 film in the whole wide world? A 99? I can't say that I concur with my colleagues on that score.

A Separation explores how presumed social norms are extremely tenuous and how threats to these almost illusory ideas can threaten our sense of personal security.

Or, would the tax deductions on the existing mortgage generate tax savings great enough to cancel the benefit of making additional principal payments or refinancing to a 15-year fixed-rate loan. What's the best choice?

My other concern is that I have more than $70,000 in savings, and I am wondering if I should get another house with this money or invest it somewhere more profitable. Could you please give me some options?

Dear Ken,
With a planning horizon of 10 years, it's easy to recommend you refinance at today's lower rates. You're only three years in on your existing loan, which I assume by the rate is a 30-year fixed-rate mortgage. So shortening up by a dozen years is a big financial commitment. Still, the existing mortgage plus your planned additional principal payment of $700 per month is $ 236.73 more than the 15-year mortgage payment.

The table below shows a scenario that approximates your situation, assuming you're in the 25 percent marginal federal income tax bracket, and you can fully utilize the mortgage interest deduction on your income tax return. I assume an additional principal payment on the 15-year loan, so the monthly cash flow is the same regardless of which approach you take.

Don't let taxes be the 'tail wagging the dog' in making a mortgage refinance decision. Losing the tax deduction reduces your after-tax savings, but in the example above, you're still saving almost $35,000. You want to compare the effective rates on your loans, not the size of the tax deduction. Holding on to a 5 percent mortgage when you can get 3.5 percent financing doesn't makes sense from a tax perspective. It can make sense if you don't plan on being in the house long enough to recoup the closing costs in the form of interest savings.

As to how to invest $70,000 in savings after making sure you have an emergency fund that covers three months to six months in living expenses, take a look at your overall portfolio. You already have $400,000 invested in real estate. Do you want to add to that asset allocation in your portfolio? I wouldn't, unless you have a substantial investment portfolio.

Focus on the life goals you want the investments to finance in the future, balance it against the risks you're willing to assume when investing, and find the investment option that you're comfortable with to achieve these goals.

What I'm Reading ? Making A Home And Family

A few weeks ago, I ordered a bunch of books from the library and they just happened to come in at the same time as my Amazon order.? I kept my audio book and started digging into my Amazon pile!

I am currently reading Beyond the Sling by Mayim Bialik, PhD.? I have always loved Mayim, and it all started with Blossom of course.? I even wore a denim hat with a huge flower on it so I could be like her.? Anyway, I will stop embarrassing myself now.? I am really loving this book though!? It?s an excellent combination of explaining Attachment Parenting, how she parents, and why she chooses to parent that way based on her neuroscience degree.? She talks about how our bodies and brains (and of course our children?s) react when we breastfeed, touch, cuddle with, and speak compassionately to them. I am looking forward to reading more of it ? hopefully today with some tea.

The other book I kept from the library, isn?t actually a text book but an audio book.? It was recommended to me by many people, and the audio came especially recommended.? If you drive often to and from work or a regular commute (mine isn?t regular, but I listen on my long trips to town), I highly recommend the audio of The Help!? There?s always the regular book too, but the audio has the amazing voices that brings the story right to life in your car.? It is set in the 1960?s and tells the story of two black maids and the racism they face working for white families.

The Secret World of Arrietty is a marvelously captivating animated feature about very tiny people and the full-scale world they inhabit.

Yonebayashi gives Arrietty an excellent sense of balance, with the adventure aspects of the story, which feel legitimately dangerous providing well-paced contrast the film's more placid moments.

It's an enjoyable and attractive-looking film, but a little of that "Speed Racer" energy wouldn't have been such a bad thing.

The visual details are inventive, and the animation - particularly the colors - is lovely.

"The Secret World of Arrietty'' is a feast for the eyes that will engage the entire family.

The Secret World of Arrietty is sweet fun, an astute match of exquisite style and small content.

It certainly belongs in the second rank of Ghibli fantasies. But give it a chance.

Most will be caught up in its beautiful spell, immersed in great storytelling at its finest.

The soft-focus animation has an impressionistic quality, as if a gentle breeze had wafted across a Monet canvas.

This smart, winsome fairy tale is not quite Hiyao Miyazaki, but it still might be the best animated film that (some few) will see all year.

Another Studio Ghibli wonder, as heartbreaking for its devotion to craft, artistry and intelligent storytelling (for viewers of all ages) as for its themes of inevitable exile and impossible love.

There's a gentle movie from Japan that's going to seem familiar to a lot of fans of the series of books about 'The Borrowers.'

...yet another jewel in the crown of Studio Ghibli.

...creates a sense of wide-eyed wonder and discovery as we experience the awe-inspiring mysteries of an ordinary house as seen from the four-inch borrower's point of view.

The animation, a gorgeous blend of bewitching watercolored backgrounds and poignantly rendered characters, is, as ever, beyond reproach.

What is most effective is the way the sense of peaceful shelter and retreat in the country setting contrasts with the precariousness of the situations faced by Shawn and Arrietty.

It's hard to imagine this scenario playing out with more delicacy and care than animator-turned-director Yonebayashi Hiromasa brings to bear.

Arrietty has an elegiac mood, like a more wan and sedate Toy Story.

Gently enchanting, an extraordinary adventure

There may not be a frenzy of action and fast cuts but each scene has meticulous details about how the borrowers live, how they make use of the things in their environment to survive.

Tiny people who live in the walls of a rural home are put at risk when they are discovered by the humans residing there. Studio Ghibli offers a soothing animated version of the classic children's novels.

the basic elements of loneliness, friendship, and the fragility of life are intact, along with that ineffable sense of wonder, melancholy, and magic

By being less bizarre than SPIRITED AWAY and having more of a human center to the film, THE SECRET WORLD OF ARRIETTY is one of Studio Ghibli's best efforts to date.

Goodrich's 27 leads Kansas past Delaware 70-64

(AP) ? The team that lost its top scorer to injury more than a month ago took one of college basketball's biggest stars out of the NCAA women's tournament.

Angel Goodrich scored 27 to lead 11th-seeded Kansas to a 70-64 win over third-seeded Delaware and the nation's leading scorer, Elena Delle Donne, on Tuesday night.

Delle Donne finished with 34 points for the Blue Hens (31-2), who had their 21-game winning streak snapped.

The Jayhawks (21-12), improbably, moved to the second weekend of the tournament for the first time since 1998. They'll face Tennessee on Saturday in Des Moines, Iowa.

"When I was in the locker room, I told my teammates to pinch me," junior Aishah Sutherland said.

They advanced by rallying in the second half behind Goodrich, who fell one short of her career high in scoring. The junior was 12 of 21 from the field, 3 of 6 on 3-pointers, and also added six assists.

Goodrich had plenty of help from a Kansas defense that harassed Delle Donne throughout. The Jayhawks swarmed the 6-foot-5 junior, double- and triple-teaming her at times as they did their best to keep her from finding a comfort zone.

Delle Donne finished 9 of 18 from the field, 15 of 18 from the free throw line, and also had 10 rebounds. The effort, however, wasn't enough to overcome a lackluster defensive effort that allowed the Jayhawks to shoot 50 percent (30 of 60) from the field ? 17 of 28 in the second half.

"Defensively, I definitely think we let up a lot," Delle Donne said. "Defense has been our whole thing all season, so when that was failing us, that's really why things went wrong tonight."

Delaware's only other loss this season was to No. 5 Maryland on Dec. 29. The school entered the tournament having never won an NCAA game before its opening-round win over Arkansas-Little Rock, in which Delle Donne scored 39 points in 30 minutes.

Despite the success, the abrupt and unexpected end to the season was still hard to take.

"This really has been a dream season and a dream team," Delle Donne said while fighting back tears. "The thing we're most disappointed about is just it being over, especially saying goodbye to our seniors.

"I'm just sorry for the seniors and to my teammates, because we had a lot of fun."

The Jayhawks in the Sweet 16 seemed unlikely when the team's leading scorer Carolyn Davis went down for the season with a knee injury on Feb. 12.

Kansas lost six of eight to end the regular season and was anything but a certainty to make the tournament, but the Jayhawks have made the most of their stay so far. It's the school's first tournament appearance in eight seasons under coach Bonnie Henrickson.

"We've got a good team, but we have to find ways to win," Henrickson said. "We have to prove to the committee that we belong. We got to prove to them that we can win without her, and Angel has carried us and Aishah has been really, really good too."

Delaware led 37-31 at halftime, but Kansas took control early in second half behind Natalie Knight. The freshman, who scored only five points in the Jayhawks opening-round win over Nebraska, was scoreless at halftime before scoring eight points in a row at one point to put Kansas up 50-43.

That capped a 19-6 run to open the second half for the Jayhawks, and it was part of a 13-0 run that put them up 53-43 after a free throw by Chelsea Gardner, who finished with 10 points. Sutherland added 12 points and 11 rebounds despite battling foul trouble for much of the game while guarding Delle Donne.

Delle Donne took control at that point with Delaware's season on the line. She scored 12 straight points, the last three on free throws after she was fouled on a 3-point attempt, to pull the Blue Hens within 59-57.

They were never able to get closer, however, as Goodrich answered with nine of Kansas' next 11 points. Her last during the stretch came after a steal and layup on the fast break to put the Jayhawks up 68-57 ? their largest lead of the game.

Delaware was unable to get closer than six points after that.

"We will be back," Blue Hens coach Tina Martin said.
